This Privacy Policy (“Policy”) applies to services provided by New Matter Brand, Inc.  (“we”, “us”, or “Company”) and our website, product pages, or other digital or physical products that link to or reference this Policy (collectively, the “Services”) and explains what information we collect from users of our Services (a “user”, “you”, or “your”), including information that may be used to personally identify you (“Personal data”) and how we use it. We encourage you to read the details below. This Policy applies to any user or visitor to or user of our Services or purchaser of our products. We reserve the right to change this Policy at any time. We will notify you of any changes to this Policy by posting a new Policy to the Services, and/or by sending notice to the primary email address specified in your account. You should periodically check our website, including this privacy page, for updates. You acknowledge that your continued use of our Services after we publish or send a notice about our changes to this Policy means that the collection, use and sharing of your Personal Data is subject to the updated Policy.

Types of Personal Data Collected

We collect the following Personal Data from you: 

  • Usage data regarding how you interact with our Services.
  • Account registration data, which includes your name, username, date of birth, credit or debit card information, age, phone number, email address, postal address, and country.  You may update or correct your account registration data in the Services via your profile.
  • Any other Personal Data that you voluntarily submit to us or provide to the Services.

 

If you sign-up to access the Services via a third party platform, such as Facebook or Google, your interactions and any information you provide to the third party will be governed by their respective privacy policies, which we encourage you to review for more information about their data practices. Personal Data may be freely provided by you, or, in case of usage data, may be collected automatically when you use the Services through the use of tracking technologies as further described in this Privacy Policy. Unless specified otherwise, all Personal Data requested by the Services is mandatory and failure to provide this Personal Data may make it impossible to provide the Services to you. To the extent that you transfer or submit any third-party Personal Data, orders for another person containing third-party Personal Data,  you are responsible for any third-party Personal Data obtained, published or shared through the Services and confirm that you have the third party's consent to provide their Personal Data to the Company.

 

Other Collection of Information

Personally Non-Identifiable Information:   We may collect personally non-identifiable information, including but not limited to demographic data, age, education level, profession, geographic location or gender, from you at the time of registration on our Website or app, or when you choose to use our Services. This information is not, by itself, sufficient to identify or contact you.  The Company may store such information, or it may be included in databases owned and maintained by partners, affiliates, agents, or service providers of the Company.  The Company may use such information and pool it with other information to track data related to growing the business, such as the total number of visitors to our Website and the domain names of our visitors' Internet service providers.  

 

Location-Based Information.   Our Service may use location-based services in order to locate you so we may verify your location, deliver you relevant content based on your location as well as to share your location with our vendors as part of the location-based services we offer, including to deliver your orders. We may, from time to time provide settings in the Services that permit you to disable location-based services. 

 

Passively Collected Information:   Your visit to our Website may allow us to obtain certain additional, personally non-identifiable information that is collected passively using various technologies.  This information includes but is not limited to, for example, IP addresses, browser types, date and time of page views, location information associated with your IP address, domain names, your interactions to an ad delivered by us or our ad technology partners and other anonymous statistical data involving your use of the Website and/or our services.  This information cannot presently be used to specifically identify you.  

 

Aggregated Personal Data:   The Company may analyze your Personal Information provided through the Website or in connection with rendering the Services, in aggregate form.   This aggregate information does not identify you personally.   We may share this aggregate data with our partners, affiliates, agents, or service providers for business purposes.   We may also disclose aggregated statistics to explain our Services to current and prospective business partners, and to other third parties for other lawful, business-related purposes. 

 

Customer Credit Card Information.   The Company uses a third party to keep a protected copy of your credit card number. This billing data belongs to you, and by utilizing the Service, you grant the Company a license to use this data to bill you for services rendered.

 

Use of Tracking Technologies

 

We may, either directly or through third party companies and individuals we engage to provide services to us:

  • Track your use of our Website and the Services for purposes of our own customer support, analytics, research, product development, fraud prevention, risk assessment, regulatory compliance, investigation, etc.
  • Track your use of the Website and the Services to enable you to use and access the Services and pay for your activities on the Website and through the Services.  
  • Track your behavior on our own Website and use of the Services to market and advertise our services to you on our Website platform and third party websites.  You may opt out of receiving advertisements by visiting the Network Advertising Initiative (http://www.networkadvertising.org/choices/) and/or the Digital Advertising Alliance (http://www.aboutads.info/choices/).  Please note that even if you choose to opt-out of receiving targeted advertising, you may still receive advertising on the Services, generally.  The advertising will simply not be targeted or specific to your interests.

We collect information through the use of “cookies”, web beacons/tracking pixels, log files, data analytics tools, and other third party technologies to understand how you navigate through and interact with our Services.

  • Other Partners and Service Providers: We work with a wide range of third party providers, notably our database administrators, payment processors, cloud computing services, data analytics, advertising, and other application service providers. 

 

Methods of Processing

The Company takes appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of Personal Data. The processing of Personal Data is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Company, in some cases, the Personal Data may be accessible to certain types of persons in charge, involved with the operation of the Services (administration, sales, marketing, legal, system administration) or external parties (such as third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors by the Company. 

Legal Basis of Processing

Our lawful bases for processing Personal Data include instances where:

Retention and Storage

Personal Data shall be processed and stored for as long as required by the purpose they have been collected for. Therefore:

  • Personal Data collected for purposes related to the performance of a contract between the Company and you shall be retained until such contract has been fully performed.
  • Personal Data collected for the purposes of the Company’s legitimate interests shall be retained as long as needed to fulfill such purposes. You may find specific information regarding the legitimate interests pursued by the Company within the relevant sections of this document or by contacting the Company.

The Company may be allowed to retain Personal Data for a longer period whenever you have given consent to such processing, as long as such consent is not withdrawn. Furthermore, the Company may be obliged to retain Personal Data for a longer period whenever required to do so for the performance of a legal obligation or upon order of an authority.

How We Respond to Do Not Track Signals

Your browser settings may allow you to automatically transmit a Do Not Track signal to websites and other online services you visit. We do not alter our practices when we receive a Do Not Track signal from a visitor’s browser. Children Under 16

The Services are not directed to individuals who are under age of sixteen (16) and we do not solicit nor knowingly collect Personal Data from children under the age of sixteen (16). If you believe that we have unknowingly collected any Personal Data from someone under the age of sixteen (16), please contact us immediately at hello@newmatter.com and the information will be deleted.

 

Testimonials, Ratings, and Reviews

If you submit testimonials, ratings, or reviews of the Services directly on our site, any Personal Information you include will be displayed on the site.  We may also partner with third-party service providers to collect and display ratings and review content on our site.  If you provide our third-party service providers with your Personal Information in the process of submitting your rating and review, the content and Personal Information collected by a third party will be posted on our site, absent your express instruction not to do so.  If you want your testimonial, rating, or review removed from our site at any time, please contact us at hello@newmatter.com.

 

Referrals

If you choose to use our referral service to tell a friend about our Services by email, we will ask for your friend’s email address, and send your friend a one-time email inviting them to visit our site and inform them of our Services.  We will only store your friend’s email address for the sole purpose of sending this one-time message and tracking the success of the referral program. Your friend may contact us at hello@newmatter.com to request that we remove this information from our database at any time.

If you submit any Personal Information relating to other people to us or to our service providers in connection with our Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Policy.  

A Note to Users Outside the United States

Our Company is based in the United States. The Services are controlled and operated by us from the United States and are not intended to subject us to the laws or jurisdiction of any state, country or territory other than that of the United States. Your Personal Data may be stored and processed in any country where we have facilities or in which we engage service providers, and by using the Services you consent to the transfer of information to countries outside of your country of residence, including the United States, which may have data protection rules that are different from those of your country. In certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your Personal Data.

Information for EEA Residents

If you are a California resident, you may make your Do Not Sell My Personal Information request(s) below. While we do not sell your information in the usual sense, we may participate in interest-based advertising networks.  This data does not typically identify you by name or other directly identifiable means. Rather, data about the content and advertising you view on this and our commonly branded sites, how you arrived at the sites, and your general location is added to unique online profiles about your browser and device maintained by us and third party advertising, social media and analytics businesses. This data is used by each of us to help understand how our site or sites are used, to personalize our content, and to tailor advertising on our sites and across the internet to your perceived interests. 

The California Consumer Privacy Act (CCPA) considers the sharing of some of this data, particularly when used for the third-party’s commercial advertising purposes, to be a “SALE” of personal data even if no money is exchanged.
